Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and Cachey (“Cachey,” “we,” “us,” or “our”) governing your access to and use of the Cachey website, applications, and the Cachey browser extension (together, the “Service”). By creating an account, installing the extension, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

Your account

  • You are responsible for the activity that happens under your account and for keeping your login credentials secure.
  • You agree to provide accurate account information and to keep it up to date.
  • Notify us promptly if you suspect any unauthorized use of your account.

Acceptable use

You agree not to:

  • Use the Service to store, upload, or distribute content that is unlawful, infringing, or that you do not have the right to use.
  • Violate the intellectual property, privacy, or other rights of any third party.
  • Attempt to access, probe, disrupt, or reverse engineer the Service, or circumvent any security or rate-limiting measures.
  • Use automated means to scrape or overload the Service, or resell or sublicense access without our permission.
  • Upload malware or use the Service in any way that harms Cachey, its users, or others.

Your content

You retain all ownership of the images, metadata, and other content you add to Cachey (“Your Content”). You grant us a limited, non-exclusive license to host, store, process, and display Your Content solely to operate and provide the Service to you — including generating searchable metadata and syncing your library across your devices. This license ends when you delete Your Content or your account, except for content already removed from active systems but retained transiently in backups for a limited period.

You are solely responsible for Your Content and for ensuring you have the rights necessary to save and store it. The Service lets you save images you encounter online; you are responsible for respecting the rights of the original creators and the terms of the sites you save from.

AI-generated metadata

Cachey uses automated and AI systems to generate titles, descriptions, tags, and similar metadata to make your library searchable. This metadata is provided on an “as is” basis, may be inaccurate or incomplete, and should not be relied on as authoritative. You may edit or remove generated metadata.

Copyright & takedowns

We respect intellectual property rights. If you believe content on the Service infringes your copyright, contact us with enough detail to identify the work and the material in question, and we will review and respond, including removing infringing content where appropriate. We may suspend or terminate accounts of users who repeatedly infringe.

Cachey's intellectual property

The Service itself — including its software, design, branding, and content we provide (excluding Your Content) — is owned by Cachey and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service in accordance with these Terms. No other rights are granted.

Plans, billing & refunds

  • Cachey offers free and paid plans. Paid plans are billed in advance on a recurring basis through a third-party payment processor; we do not store your full payment card details.
  • Your subscription renews automatically until cancelled. You can cancel at any time from Settings; cancellation takes effect at the end of the current billing period.
  • Except where required by law, payments are non-refundable and partial periods are not pro-rated.
  • We may change plan pricing or features with reasonable notice; changes apply to the next billing period.

Termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Upon termination, your right to use the Service ends and we may delete Your Content in accordance with our Privacy Policy.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content will be preserved without loss. You are responsible for keeping your own copies of important content.

Limitation of liability

To the maximum extent permitted by law, Cachey will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.

Indemnification

You agree to indemnify and hold Cachey harmless from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or any law or third-party right.

Changes to the Service or these Terms

We may update the Service and these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws applicable at Cachey's principal place of business, without regard to conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the courts located there, unless mandatory law in your country of residence provides otherwise.
